1. General
Pivovarium, online shop and services, Sabina Rozman s.p. (hereinafter referred to as the Merchant) undertakes to protect the data from any breaches and misuse. The personal data of users is one of the areas to protect the confidentiality of personal data and the privacy of the users of the online shop. The personal data collected will be used exclusively for the provision of the services offered. The Trader respects the confidentiality of personal data and the privacy of the users of the online shop, and will therefore take all necessary measures to which the Merchant pays the utmost care and attention, as it is aware of the sensitive nature of this area.
2. Use of personal data
For the purposes of providing the services offered, the trader collects, manages, processes and stores the following user data:
● first and last name;
● delivery addresses;
● company or legal entity name (if the user is a legal entity);
● the tax number of the legal entity (if the user is a legal entity);
● email address (username);
● password in encrypted form;
● a contact telephone number;
● your country of residence;
● other information that the user voluntarily enters in the forms in the online shop;
● other information that the user voluntarily adds subsequently in his/her profile.
The Merchant shall not be liable for the accuracy, completeness and timeliness of the information entered by Users.
3. Cookies and IP addresses
At the start of each use of the online shop, the trader assigns each user a cookie for identification, shopping basket monitoring and traceability purposes, which is stored in the server's memory only for the duration of the visit to the online shop and is deleted after one hour of inactivity. The Pivovarium.si online shop may also store on the user's personal computer some persistent cookies, such as the user's identification number in encrypted form for recognition on the next visit to the online shop or product ratings, which allow the user to know which products he has already rated, and indirectly also cookies from the external service Google Analytics, which are used to analyse visits to the website. The trader may use this data in an anonymised aggregated form for statistical analysis purposes. For the purposes of ensuring online security, the Trader also collects the IP addresses from which users access the online shop.
4. Declaration on the protection of the confidentiality of personal data and the privacy of users
The trader is obliged to protect the personal data of the users of the online shop in accordance with the regulations governing the protection of personal data. Under no circumstances shall the Trader, without the express permission of the User, disclose the User's personal or other data to a third party or allow a third party to access the User's personal or other data, unless required to do so by the public authorities, if such an obligation is provided for by law, or in the good faith belief that such action is necessary for legal proceedings before the courts or other public authorities and for the protection and pursuit of the Trader's legitimate interests.
All personal and other data provided by the user when logging in to the online shop, as well as when ordering the purchase of products, including the content of orders, will be protected in accordance with the regulations governing the protection of personal data. The trader will not use this information for any purpose that would in any way harm the user or any other person involved. The Merchant will not use the User's data to send promotional emails or other unsolicited promotional material, except to send those promotional notices to which the User has subscribed or consented. The trader may use the data in anonymised aggregated form for statistical analysis purposes. The confidentiality of personal and other data of Users will not be violated in any form.
The Merchant will only provide the delivery service with the information necessary for the delivery of the products purchased in the online shop (recipient's details and delivery address). The Merchant will contact the User by e-mail if necessary for the completion of the purchase in the online shop, and by telephone only if there are problems during the registration or purchase process in the online shop.
If you send us an enquiry via the contact form, your email address will only be used to reply to your enquiry. We do not store your address in a database, nor do we use it for any marketing advertising.

Every user who has registered in our online shop has the right to know what information we collect about them and for what purposes. In accordance with this right, you may request from us a copy of the data we hold about you in our online shop and we will provide you with information about your activity as soon as possible or within one month at the latest.

The obligation to protect personal and other data shall apply indefinitely, even after the termination of the relationship with the Trader.
Registered users may stop using the Online Shop at any time and may cancel their registration. They do so by notifying the Merchant of the cancellation in writing. Before giving notice of cancellation of registration, the User must pay to the Merchant all outstanding obligations arising from purchases made in the Online Shop. The Merchant will protect the confidentiality of personal data and the privacy of the users of the Online Shop within the scope of this Privacy Policy, even in the event of cancellation of registration.

Conditions of use
1. General
The Terms and Conditions of Use are drawn up in accordance with consumer protection regulations, based on the recommendations of the Slovenian Chamber of Commerce and Industry and international codes for online and electronic commerce. The online shop Pivovarium.si (hereinafter referred to as the "Online Shop") is operated by Sabina Rozman, s.p., a provider of e-commerce services (hereinafter referred to as the "Merchant").
By registering in the online shop, the visitor acquires a username identical to his/her e-mail address and a password set by the user. The username and password unambiguously identify and link the user to the data entered. By registering, the visitor confirms and warrants that he or she is a person of full legal age and legal capacity. By registering, the visitor becomes a user and acquires the right to purchase. By purchasing a product, the user becomes a customer.
These Terms of Use define the operation of the online shop, the rights and obligations of the visitor, the user and the buyer, and the business relationship between the Trader and the user as a buyer of products from the online shop.
2. Accessibility of information
The trader undertakes to make them available to the user at all times:
● the identity of the Trader (in particular the company name and registered office and the number of the register where the company is registered);
● contact details to enable the user to communicate quickly and effectively with the Trader (email address, telephone, etc.);
● information on the essential features of the products or services offered by the online shop, including after-sales services and guarantees;
● information about the availability of products or services offered by the online shop;
● the manner and conditions of delivery of the products or services, in particular the place and time of delivery;
● information on how to pay;
● information about the validity period of the offer from the online shop;
● information on the period during which it is still possible to withdraw from the contract and the conditions for withdrawal;
● information on the possibility of returning products and if and how much such returns cost the user;
● information about the User complaint procedure and the contact details of the Trader's contact person for Users.
3. Product offer, delivery time and acceptance
Due to the nature of doing business online, the product range in the online shop changes and is updated frequently and quickly.
The delivery time for products in stock is 2 to 3 working days for delivery addresses in Slovenia, unless the delivery service delivers to the individual delivery address later (see point 10). Each product from the online shop is available within a reasonable time.
When placing a purchase order, the user may specify one of the following methods of collecting the products:
● in person at the company's registered office, in which case no delivery charges will be payable;
● by delivery, in which case delivery charges will also apply.
4. Payment methods
The trader offers the following payment methods for the purchase of products from the online shop:
● by advance payment of the purchase price to the Trader's transaction account after the offer or invoice has been made, in which case the online price applies (see point 5.);
● by prepayment using a credit card after a quotation or invoice has been made, in which case the online price applies (see point 5);
● by prepayment via PayPal after the offer or invoice has been made, in which case the online price applies (see point 5).
5. Prices
The online price applies to all registered users of the Trader's online shop. Surcharges may be applied to the online price depending on the payment method chosen (see section 4.).
All prices in the online shop are quoted in euros, unless explicitly stated otherwise. The prices in the online shop are the prices of the products and do not include delivery charges (see points 3. and 10.). The prices apply only to the electronic ordering of products via the online shop.
All prices are valid at the time of ordering and have no pre-determined validity and are therefore valid only until changed from time to time. Despite the Merchant's care to provide the most up-to-date and accurate information, it is possible that a price may be incorrect. In the case referred to in the preceding sentence and in the event that the price of the Product changes during the processing of the order, i.e. from the moment of placing the order until the order is confirmed, the Merchant will:
● notify the user (customer) of the new prices, in which case the user (customer) shall have the option of modifying or cancelling the order in whole or in part or confirming the order at the new prices, all at no additional cost; or
● enable the user (buyer) to withdraw from the purchase and at the same time offer a win-win and mutually satisfying solution.
6. Purchase procedure
6.1. Technical steps leading to the conclusion of the Purchase Contract
The following technical steps are available to the user (buyer) during the purchase process:
● logging in to the online shop using an email address or a user password if the user (customer) has already created a user account (see also point 1.);
● search for a product in the product range in the online shop;
● selecting a product to buy;
● adding the selected product to your shopping basket;
● determining the quantity of the product to be purchased in your shopping basket;
● view the price of the selected product in the selected quantity, including the tax charged, if applicable;
● choosing how the product will be delivered (see also points 3. and 10.);
● choice of payment method (see also point 4.);
● an overview of the order, including the delivery method chosen and the delivery charges, if any; and
● confirmation and award of the contract, thus completing the purchase (see also points 6.3 and 6.4).
6.2. Technological means to identify and correct errors before the award of a contract
Before placing an order, the user (customer) is given the opportunity via a graphical user interface to place an order with immediate effect, easily and hassle-free:
● sees and reviews the products he has selected and added to his shopping basket;
● see and review the price of each product and the total price of the entire selected quantity of each product;
● modifies the selected quantity of a product and calculates the new price of the modified quantity;
● removes selected products that you do not wish to purchase from your shopping basket; and
● calculate any applicable tax, according to the tax rate applicable to the product chosen and its price (tax base).
Before confirming the order, the user (customer) is given the opportunity to make an immediate, easy and hassle-free order via a graphical user interface:
● changes the delivery method you choose for the product;
● changes your chosen payment method; and
● review and approve individual changes
6.3. Order accepted
After placing an order, the user (buyer) receives an e-mail from the Trader informing him/her that the order has been accepted. Within 1 hour of receipt of this notification, the User (Buyer) has the option to cancel the order without any consequences. Except for the cancellation option, the User (Buyer) cannot change the content of the order after the order has been placed. The User (Buyer) shall at all times have access to comprehensive information on the status and content of each order in his/her profile on the Merchant's website.
6.4. Order confirmed
If the user (buyer) does not cancel the order, the order will be processed further. Upon receipt, the trader will review the order, check the deliverability of the products ordered and confirm or reject the order with a reason. The trader may also contact the user (buyer) by telephone on the contact telephone number provided to verify the information or to ensure the accuracy of the delivery. Upon confirmation of the order, the Trader shall inform the User (Buyer) by e-mail of the estimated delivery date. At this stage, the purchase contract for the purchase of the ordered products between the user (buyer) and the Trader is irrevocably concluded (see point 7.).
6.5 Goods dispatched
The Trader shall prepare and dispatch the ordered products within the agreed time limit and shall notify the User (Buyer) thereof by e-mail. In the e-mail referred to in the preceding sentence, the Trader shall also inform the User (Buyer) of the product return policy and shall inform the User (Buyer) of the contact persons in the event of a complaint or delay in delivery.
7. Purchase Agreement
The trader shall issue the user who purchases a product from the online shop with an invoice in writing, itemising the costs and explaining the right to withdraw from the purchase by returning the purchased product, if necessary and possible. The purchase contract in the form of a purchase order is stored electronically on the Merchant's server and is accessible to the User (Buyer) at any time in his/her user profile. The Purchase Agreement shall be concluded in the Slovene language.
The purchase contract between the Merchant and the User (Buyer) is concluded at the moment the Merchant confirms the order (see Section 6.2). From that moment on, all prices and other terms and conditions of purchase are fixed and apply to both the Merchant and the User (Buyer).
8. Right of withdrawal, return of products
The User (Buyer) has the right to notify the Trader within 14 days from the date of receipt of the ordered products to the contact email address info@pivovarium.si that he/she withdraws from the Purchase Agreement, without having to provide a reason for such a decision. The return of the purchased products to the Trader within the withdrawal period shall be deemed to be a withdrawal. The only cost to be borne by the User (Buyer) as a result of the withdrawal from the Purchase Contract shall be the cost of returning the products to the Trader.
Purchased products must be returned to the Trader no later than 30 days from the date of the notice of withdrawal from the purchase contract. Purchased products must be returned to the Trader undamaged, in their original packaging and in the same quantity, unless the products are destroyed, damaged, lost or reduced in quantity without any fault on the part of the user (buyer). If the postal package in which the User (Customer) received the ordered Products is physically damaged, if the contents are missing or if it shows signs of opening, the User (Customer) must initiate the complaint procedure with the delivery service (see point 14). The possibility of return does not apply to software, audio and video media or if the User (Customer) has opened the security seal.
For returned products, the Trader shall refund the amount paid or the gift voucher redeemed to the User (Buyer) as soon as possible, but at the latest within 30 days from the receipt of the cancellation message, and any promotional codes and other discounts redeemed shall not be refunded to the User (Buyer). The refund shall be made by the Trader to the personal or transaction account of the User (Buyer). The Merchant shall return the redeemed gift voucher in the form of a credit.
9. Warranty
Products are guaranteed if stated on the invoice or warranty card. The warranty is valid subject to the instructions and conditions stated on the warranty card and on presentation of the invoice. The warranty period is indicated on the warranty card or on the invoice. Warranty information is also given when the product is presented in the online shop. If there is no warranty information in the online shop, then the product has no warranty.
The user (buyer) can claim the warranty from the Trader or directly from the manufacturer of the product or its authorised repairer. The Buyer can claim the warranty by means of a warranty certificate and an invoice. The manufacturer or its authorised repairer is obliged to carry out the warranty repair within 45 days from the date of receipt of the product for repair, otherwise the product will be replaced by another equivalent product in perfect condition.
10. Delivery
The trader will deliver the ordered products to the user (buyer) within the agreed time limit. The trader reserves the right to choose another delivery service if this will enable the order to be fulfilled more efficiently. The delivery services are provided by DPD d.o.o. COURIER AND PARCEL DISTRIBUTION.
11. Security
The trader shall use appropriate technological and organisational means to protect the transmission and storage of personal data and payments. For these purposes, the Merchant uses a 128-bit SSL certificate issued by an organisation authorised for this purpose.
It is also the user's responsibility to ensure the security of their username and password, and to ensure that their computer is properly protected by software and anti-virus.
12. Childcare
During the purchase process of the selected products, the customer must confirm his/her age of majority by means of a pop-up window, declaring that he/she meets the legal age limit of 18 years for the purchase of alcoholic beverages.
The trader shall not accept orders in the online shop from someone he knows or suspects to be a child without the express permission of the child's parents or guardians. The trader shall not offer free access to products or services in the online shop that are harmful to children.
The trader will not accept any personal data concerning children without the express permission of the parents or guardians, nor will the trader disclose any data received from children to third parties other than the parents or guardians.
Any communication aimed at children will be age-appropriate and will not exploit children's trust, lack of experience or sense of loyalty.
13. Privacy Policy
The Privacy Policy is also part of the Terms of Use and is available in the first part of this page.
14. Responsibility
The Trader shall use its best endeavours to ensure that the information published in its online shop is up-to-date and correct, but the characteristics of the products, the delivery date or the price may change so rapidly that the Trader is unable to correct the information published in its online shop in time. In such a case, the Trader will inform the user (buyer) of the changes and give him the opportunity to cancel or modify the order (see point 5.).
Although the Trader endeavours to provide accurate photographs of the products for sale in the online shop, all photographs should be taken as symbolic. Photographs do not guarantee the characteristics of a product.
The trader shall not be liable for any physical damage, destruction or loss of the consignment from the moment the consignment of the products ordered is delivered to the post office, or if the contents of the consignment are missing or if the consignment shows signs of having been opened. In these cases, the user (buyer) must initiate a complaint procedure with the carrier. In the event of damage to the consignment, he/she shall do so by bringing the consignment to the nearest post office in the same condition as received, without adding or removing anything, and by completing a claim report. The trader will work with the delivery service to ensure that the complaint is resolved as quickly as possible.
15. Complaints, disputes and application of the law
The trader complies with applicable consumer protection laws. The trader has an effective complaints handling system in place and has a designated person who can be contacted by phone or email in case of problems. In case of problems, the user (buyer) may contact the Customer Service Centre at the following telephone number: 0038630315024. The user (buyer) may send a complaint to the following e-mail address: info@pivovarium.si. The complaint procedure is confidential.
The trader will acknowledge receipt of the complaint within five working days, let the user (customer) know how long it will take to process the complaint, and keep the user (customer) informed of the progress of the complaint. The Trader will use its best endeavours to resolve any disputes amicably. If no amicable settlement is reached, the local court of jurisdiction in Radovljica shall have exclusive jurisdiction to settle any dispute between the Trader and the User (Buyer). The Merchant and the User (Buyer), as participants in electronic commerce, mutually acknowledge the validity of electronic messages in court.
These Terms of Use and all disputes between the Merchant and the User (Customer) are governed by and governed by Slovenian substantive and procedural law, without giving effect to any rules of private international law that would refer to the application of any other law.
The provisions of the Code of Obligations, the Act on Electronic Commerce on the Market, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis to all relationships and rights and obligations not governed by these Terms of Use.
16. Changes to the Terms of Use
In the event of changes to the regulations governing the operation of online shops, data protection and other areas related to the operation of the online shop of the Trader, and in the event of changes to its own business policy, the Trader may amend and/or supplement these Terms of Use, which will be notified to the users in an appropriate manner, including in particular by means of the Pivovarium.si website. Any amendments and/or modifications to the Terms of Use shall enter into force and shall be applicable upon the expiry of an eight-day period from the date of publication of the amendments and/or modifications. If a change and/or amendment to the Terms of Use is necessary in order to comply with regulations, such changes and/or amendments may exceptionally enter into force and application within a shorter period of time.
A User who does not accept the changes and/or amendments to these Terms of Use must cancel his/her registration within eight days from the date of publication of the notice of the change and/or amendment to the Terms of Use, otherwise, after the expiry of this period, the User shall be deemed to have accepted the changes and/or amendments to the Terms of Use, and no evidence to the contrary shall be admissible to prove that the User accepts the changes and/or amendments to the Terms of Use. Cancellation of registration shall be effected by the User notifying the Merchant of the cancellation by written statement.
